Who Can File a Wrongful Death Claim?

California makes it simple when it comes to deciding who can file a wrongful death claim. Those who file a claim must be able to say they experienced an economic loss due to their loved one’s death. As shown in the California Code of Civil Procedure § 377.60-377.62, some claimants may include:

  • The surviving spouse, domestic partner, or putative spouse;
  • Children and/or stepchildren; and
  • Parents, particularly if they were financially reliant on the deceased.

Other minors who have resided with the deceased for at least 180 days prior to the accident and depended on the deceased for at least half of their support costs may also be listed in a Los Angeles wrongful death claim and receive a settlement.

California Statute of Limitations for Wrongful Death Claims

Often, wrongful death lawsuits must be filed within two years of the victim’s death, but this time limit can be as short as six (6) months if a public or governmental entity caused or contributed to the victim’s death. However, to ensure the claim is successful, time is of the essence, and it is beneficial to file your claim as soon as possible.

What Damages Can Be Recovered After a Successful Wrongful Death Claim?

Los Angeles wrongful death compensation is designed to cover both economic and non-economic damages. Though no amount of money can truly bring your family comfort for the loss of a loved one, a wrongful death settlement is intended to lessen your burden from the loss. Compensation can be sought for:

  • Medical expenses;
  • Funeral and/or burial costs;
  • Loss of financial support (loss of income, wages, and/or gifts);
  • Loss of household services (child care, home maintenance, food preparation); and
  • Pain and suffering.

Compensation for the loss of consortium, companionship, moral support, training, and/or guidance is also available to those left behind by the deceased. Generally, there is not a cap placed on wrongful death claims. This means your family may receive compensation for a variety of different losses. The more financially dependent your family was on your deceased loved one, the more compensation you can receive.

Punitive damages may also be imposed on the defendant if the death was a result of homicide. This is designed to further punish them for the harm he or she caused. Punitive damages are then awarded to the victim, in this case, the deceased. Alongside a wrongful death settlement, survival action claims allow the estate of the deceased to file a claim for the pain and suffering sustained by the victim before they succumbed to their injuries.
